Legal Framework of Digital Economy and Digital Trade under the Belt and Road Initiative

A Path to Digital Silk Road

Jamil Afzal | Yongmei Chen

Law / International

This book explores the Digital Economy Framework within China’s Belt and Road Initiative (BRI), an ambitious strategy designed to strengthen connections between China and countries across Asia, Europe, and Africa. While the BRI is often associated with physical infrastructure like roads, railways, and ports, this book focuses on its digital dimension: how participating states cooperate in the online and technology-driven economy.  The rapid expansion of digital activities across borders generates complex legal challenges involving data protection, cybersecurity, digital trade rules, and the rights and obligations of states, companies, and individuals. So there is a “dire need” to regulate the digital economy of the BRI. Because of its focus on the intersection of international law and digital economic integration, the book is especially useful for researchers, students, and policymakers who want to understand the detailed, nuanced legal and policy issues emerging from the Digital Silk Road and BRI. The chapters in this volume are carefully structured to guide the reader from foundational concepts to advanced legal and geopolitical implications. The opening chapters explore the evolution of China’s digital economy, its integration with the BRI, and the scope and impact of the Digital Silk Road across different regions. Subsequent chapters examine critical legal dimensions, including data governance, cybersecurity, digital trade regulations, and international legal frameworks. Particular attention is given to emerging issues such as data sovereignty, cross-border transactions, fintech innovation, and digital dispute resolution mechanisms. The book also addresses challenges, including regulatory fragmentation, jurisdictional conflicts, digital inequality, and geopolitical tensions. It further explores forward-looking themes such as green digital economy initiatives, theoretical frameworks of digitalization, and the development of a common legal structure for digital trade. The concluding chapters assess the broader implications of the Digital Silk Road on global governance, power dynamics, and the future of international law.
